Company A in my case has not revoked my H1B, it's still in valid status. I had been to India too & I came back with same VISA on MARCH 12 2009. I have mentioned in the post also.

If 1099 is not acceptable with client, what is the the easiest way to go forward, assuming no intent of other employees?
I think LLC is the only option ( if I dont want to go towards C-Cop ). How long does it take to set that up? What setps? What are the expenses involved other than one time registration fee?

I asked this question several times, this is what the answer I got.
To get L-1 visa, you need to work for sister or parent company for a year outside USA. Here is the problem come.
I am on the Same boat, How care about GC. But I care about my wife's work authorisation, she has done her Ph.D and completed her 6 year H-4 too. Even if some one offers her H-1B she cannot take up, until there is a decoupling of H-1 and H-4

I entered last year on Sept 2nd when my stamp was going to expire on Sept 30th, but I had my I797 with me. The officer asked me whether I was aware that my stamp is going to expire at end of September, I said yes I am aware. He then asked me for my I797 which clearly showed my H1 is valid until 2010. After about half an hour he let me through.

What is the best way to change representation of one's case from the company lawyer to Self? Also, how long does it take for this change to take effect?
I am in a similar situation as mentioned on this thread and would like any communication regarding my case from USCIS to come to me and not the lawyer who filed my I-485 since I am leaving my current employer.
Any insight into how to tackle this would be very helpful. Thanks!
Usually in that instance, you should receive a NOID from the USCIS. It goes to your lawyer. Which is why, if you are absolutely sure that your employer will revoke the I-140, it is better to file for AC21 with your own lawyer.(Not the company lawyer). In such a case, even if USCIS sends a notice to deny, it will reach your lawyer rather than the company's lawyer

once and for all.. the adjudicators dont answer calls. its just cust service people...who are contractors. so if u dont call them.. all they will be doing is sitting around doing nothing.

Why do they have 1800 number if the have a same set of person sitting at the US CIS office and the reason why the 1800 ppl do not transfer every call to the US CIS is because they don't want to disturb them. It is exactly because of information like this that the processing is getting delayed. The official stance of the US CIS is that you should contact 1800 number, period. If you have a written/published link which says that the ppl sitting at the service center are NOT adjudicators and are there to provide status updates then kindly share otherwise please do not spread rumours. Further if the IIO are there to provide status updates then why all of a sudden they have stopped doing that?

After seeing so much activism on Dream Act in the news, I think Dream Act deserves to be passed. Recapture does not. We are responsible for it for not doing anything if Dream Act passes. Just Google Dream Act and you will see so much work done on this. Compare it to Recapture bill. Reporters will also write about issues where they see lot of activity. We are simply not doing enough.

Actually, if you apply for an F1 (fulltime student visa), it will be denied. Why? Because F1 is considered a non-immigrant visa, and USCIS knows that because you filed a 485, you DO have the intent to immigrate. I believe you can just go to school and be jobless on EAD without need for F1. The burden is on you to show that your gc employer sponsor will hire you when you get your gc (if it ever comes up - they can take away your gc anytime at the border/POE, and one question may be are you still working for the sponsor).
This is just my understanding - i talked to a lawyer about it some time ago and i certainly could have some details wrong.

I received our receipts (I-485 for my husband and mine). Under section: unknown. I do not know why it should be this. My NIW I-140 approved March/2006 in NSC. ANyone has same experience? I call USCIS, they do not know either. Ask me go to local office.:confused::confused:

Are there people with EB3 pds in 2000/2001 still waiting in that large number for GCs? I don't think so..

B. WHY should Dr. Singh or Mrs. Gandhi assist us? We are trying to emigrate FROM India, NOT immigrate to India, after all.
C. Please do not formulate random "minority community" statements. It is kind of ironic to do so, given the fact that we, the EB immigrants, are usually parts of various minority communities in the U.S., and are desperately trying to make our case to the power structure here...
Please think:

Swamy - (with due respect to IV who i totally support in every which way!) but what have u done other than joining a state chapter, contributing $$ to IV and holding signs at the DC rally.?? Is this what ur life has come to now..?? Only to motivate people to join IV..?? How long do u plan on conitnuing to do this.?? Wake up buddy..!! Yes we are stuck in this mess now having filed for AOS and the indefinite future wait for cases to be approved..!! There is no doubt about that.
But somebody like dyekek12 who seems to be new to the immigration world - whats the harm in sharing with him options that maybe more practical for him 3-5 years from now.! If somebody would have adviced me back in the hay days - i would have surely listened.! There are 3 SENIOR members who seem to agree to what i have said.! All of us cannot be socially challenged.! Once your I-140 is approved with your current employer, with the copy of your 140 approval, your new employer can file for a 3 yr H1 extension. Though it is safe to do so after you get your 3 yr H1 extension based on approved 140 from the current employer and then change jobs, this is also another option which is seldom tried by applicants...But it does work as I have seen some of my friends do so. So the key for you is to get your pending 140 cleared asap......and then ask your new employer to file for your 3 yr H1 extension in premium processing and only resign from your current job after getting H1 approved....Ofcourse, this option only works if you can secure a copy of your I-140 approval from your current employer...Else, go with option 3....
