Yes you can go to school part time on H1 for MBA. Some states allow you to claim in state tuition on H1 for state schools - that will significantly reduce the tuition bill. In addition Federal govt allows either a deduction of $4k / yr or a credit of up to $2 k / yr (search for tuition tax deduction and Lifetime Learning credits).

My husband is in H1B visa and he transfered his visa to another company. Got the I-797 approvals too. Along with that mine and my kids H4 also got approved.
Now I am urgently required to travel to India, and want to return from India without going for stamping. Here are other details.
1) Even my previous H4 visa is not expired while I return from India.
2) I have the new H4 approval notices and copy of husbands new H1s I797 with me.
Will it be an issue if I reenter without stamping. Our plan is to go for Visa stamping to any nearby consulate in US border after I come back. Please advise.

I was on F-1 Visa in 2003 I applied for the labor certification through a friend's company- call it Company- A, on the intention to to work in his company as a Network administrator. I got my labor approved and I -140 is approved too. The priority date is december 2003. All these years I was waiting for my priority date to become current.Currently I work for Company B with same job title and credentials. I have an H-1 from company B.
What do you suggest
1) Shall I go ahead and apply for the I 485 from company A (company A is willing to help). Can INS ask for the pay stubs? Becoz I never actually worked at my friend's company.
2) It will take 3-4 months for company B to finish doing my labor certification and apply for my I -140. But it would be too late for the priroty date. (It may retrogress).
3)I understand that once my current company's I -140 is approved i can request to keepo my previous priority date

Nope, 140 was approved in 2006. 485 applied July 19th, 2007. Looks like a mistake on USCIS part.
Did you filed 140 & 485 concurrently?? this is also one of the uscis check that you shouldn't filed be concurrently...

as long as your gc is pending, you can get 1 year extension. After 140 approval and 485 still pending you can get 3 year extension. OR you can apply for EAD to continue in status.

She was a graduate of UCLA, and she was a tireless DREAM Act Advocate, having testified before Congress in favor of its passage.

On appeal, the Board of Immigration Appeals found that the family could not return to Vietnam because of fear of political persecution, so the US could not remove the family to Vietnam. Having been born in Germany, the government sought to remove her to her birthplace, yet Germany refused to grant her entry. Tam was stateless. The only home she knew was the United States.

AC21: Job changed twice (Jun 06 and Apr 07). Sent EVL to USCIS both times with 'same job description' but 'different job title'.
This morning I received USCIS email alert for both my wife and I.
My I-485 application got a RFE. "We mailed you a notice requesting additional evidence". Will have to wait for the formal letter for the details. :(
My wife's I-485 application however was transferred to Newark NJ for interview. "This case has been sent for a standard interview." :confused:
I have a ton of questions at this stage. here are few in you gurus can help me while I am waiting for the RFE letter.
1) Will the RFE letter be mailed to me or my attorney ? what has been ur experience? do you get it in one week ?
2) why USCIS has split the processing of my I-485 and my wife's I-485. Her I-485 is transfered to Newark, NJ while mine is pending at TSC (now waiting for RFE response).
3) How much time will I have to respond to the RFE? Based on the new guidelines (http://www.murthy.com/news/n_timrfe.html) , I expect that to be stated in the RFE letter.

I have applied 485 in July 2, 2007. Note that my PD Jan 2001 - EB3 (priority dated ported) And I140 is already approved. I have done FP in Oct 2007. Received EAD and AP way back.But I saw LUD on my 485 application on Dec 14, 2007.
Does this mean any thing. Message content is not changed though.

If new position is similar in responsibilities, then no effect. but if the responsibilities are changing, I would recommend talking to your immigration lawyer about it

I am currently working on EAD, having invoked AC21 once in the past. My labor was filed in 2005 under EB3 (I was eligible for EB2, but my company filed it under EB3, as per their policy). I filed 485 during July 2007 fiasco and am currently working on EAD.
My job qualifies for EB1 now and few of my peers have got Green Card under EB1. Can I port my filing from EB3 to EB1? Would it be better to do it with current employer or with a new employer? Pl. advice.

I normally would say to fill the frame ..which you have done. But in this case, maybe if you had pulled back a little further, it may have given some reference to what it is. So...what is it? ;)
