Hi needed help regarding my starting date of my job. I am supposed to start my job in US on october 25th and currently i am in india. But I am still waiting for my H1B approval. If
h1b petition is approved and If I interview after October 25th(Start date) for my visa at us consulate back in Mumbai, Is it ok or will there be a problem regarding start date meaning will consulate officer ask why i am late or your start date is already gone how can i issue a visa........any adivce regarding the situation.

Requiring experience in addition to MS degree is considered "normal" for positions in Job Zone V. Whether it's more likely to trigger an audit or not - I doubt anybody will be able to tell you. For that somebody has to have experience of filing two PERMS, almost identical except for the experience requirement. I doubt many people have such an experience

Just got 3 transfer notices from CSC saying applcations transfered to NSC. Applcations reached July23rd at NSC. 140 approved from TSC.
Anybody in similar situation....

Did u call USCIS customer service and raised a service request for not receiving FP?. If not I guess you need to do that
We filed for adjustment of Status in August 2006 and received EAd's and travel documents. We have not yet received fingerprint dates. Will it take this long? Any advise on how to deal with this?

Here is my case
I came to US in Aug 2005 on F1 and My I-94 was till Duration of study.
I graduated and my OPT was from April 27th 2008 till April 26th 2009
MY company applied for my H1 on April 1st 2009 and got it approved starting Oct 1st 2009 ...but i got I 797 B ( which does not have an I-94 and is H1 approval without change of status) instead of I 797A.
I 797 B is H1 approval without change of status, My employer applied for amendment on May 2009, but again i got I 797 B instead of corrected I 797 A with a start date of october 1st. Same thing happened 3 times and now i got I 797 B again and my company says that they are going to file for the change of status again but its already November and i dont know what to do.Wanted to know if somebody has gone through the same situations and If i go to India(Chennai) for stamping what would be the problem.
what should i answer if visa officer ask's me about what have you done from April 28th 2009 tilll October 2009 and as you were not in OPT or in H1b why did you stay in US...

Sending to TSC is fine as your 140 is approved from there. My 140 was approved from TSC and my 485 was send to TSC. I was worried that it was not send to NSC but I already got my rect numbers

Hello guys,
If the employer is not willing to share your I-140 approval status with you, is there a way to find out this information from other sources?
I currently have my 485 & AP numbers but do not have I-140 number to track on the USCIS website.
Thanks for help in advance.
post the employer name and address so that other people will be careful working for him and also if employer comes to know about IV, he will stop these kind of things

A friend of mine told me that we do not have to pay Social Security Tax while working on EAD. Does anybody know if this is true ?
That would be a huge plus in case its true.
Your friend may have confused 485 based EAD with F1 OPT based EAD. On F1, you do not pay SS or Medicare. On AOS based EAD, you do need to pay SS/Medicare taxes.

Thing is inspite of these recommendations they reverted the July bulletin with no notice period to public. Not sure why they recommend and have the office Of Ombudsman if USCIS does not implement their recommendation?

The H1-B per se does not require any job experience, provided the educational qualification is exactly what the job requires. To quote, "For an H1B for a programmer, for example, a candidate must possess the required degree in the field of computer science, electrical engineering, electronics, or a related field." When the candidate has a degree in an unrelated field, the employer would usually need to prove that the candidate has work experience in the field in which the H1 is being sought.
