I know its not required to have SSN for starting the job from 10/01/2007. I am eager to know if we can apply for SSN before this date or do we need to wait until Oct 1st. Thanks

My husband is currently employed on a H1 visa and I am on a H4 visa. Our current visas(H1 and H4) are valid till January 2013. We are Candadian permanent residents who plan on ultimately applying for green cards and settling down in the US. I am a newbie in this arena and have a few questions that I tried searching answers for but couldn't find anything conclusive and would appreciate any answers
1) For various reasons can I stay back in the country for 4-6 months, while my husband goes back to Canada on the extended unpaid leave for the 4-6 months and comes back? Or if I leave with him now, can I come back after 6 months and stay here for 4-6 months? Are there any rules/regulations that prevent me from doing this. Please note that we live across the border in Canada and travel back/forth via car.
2) My hubby is planning on taking an extended unpaid leave from work( for personal and not health related reasons) and his employer is OK with that. This could be as short as 3 months and could be as long as a year. During this time we will be going back to Canada. Do you know if this will create any issues with immigration currently or in the future? How long can this leave exist?
3) If my husband ultimately comes back to a different job after this unpaid leave, will his chances of getting a visa for that new job be affected?
4) If he wants to take an extended leave do we need to leave the country? Can we take an extended leave and stay in the country? Will we be violating any rules/regulations if we do that?
5) Lets say we want to come back after 6 months, do we need to come back together?
6) If we are in Canada for the next 6 months, can we keep taking weekend trips to visit our families in US?
Would appreciate any information that anyone can provide on this.

Hello,
Did you receive the compensation at all? If so, the deposit slips from your bank may be a possibility as proof of payments. If you haven't been paid at all, you might be a victim of a bad employer and you should report the employer to Department of Labor in US.
If you are now entering US on L-2, there should not be any questions around your earlier H1-B, but the IO can always ask about your earlier stays in US and hold you up. Ask your employer to provide you a certificate on company letterhead with authorized signature stating the compensation provided to you while on H1-B, though 'I lost your paystubs' is a really flimsy excuse... ;)
Please consult a good lawyer before making any decision...

One other question. CAn I submit a query to DOL and find the status of it. Are employees allowed to do that. I remeber sending them email a while ago, and they never replied. if there is a method of obtaining this information, can somebody pleae direct me to that.

Some news are saying the Senator and the House are about to introduce seperate immigration bills. Do we still have any chances this year? Should it be easier to pass a seperate bill that may be more or less favorable to our legal immigrants?

Guys,
I spoke to another Border Post official and he suggested that i drive uptp the nearest border and they would refuse my entry to Canada as i don't have a valid visa and i can turn around and come back to US and i can get a new I-94. Do you think it would be safe to do this ?
Any advices?

Whats the cost of filing a motion to reopen the case 485 if wrongly rejected(either due to using AC21...). I mean lawyer fees + other fees.
I am sure there are folks here who went through this.
$585 per MTR (ie principal, spouse, child all seperate) to USCIS. Lawyer fee depends on nature of MTR - usually AC21 MTRs are common and the LAWYER fee must be nominal ie in the $1000 per MTR range

So in this case, the person should send the documents from India, correct? One of the requirement was I-94 card. How will we provide that if you are out of the country? What to say for Last Entry?
Q10 - Alien Registration Number (A-Number) or I-94 Number (if any)
Q12 - Provide your last date of entry
Q13 - Provide your last place of entry
It is not necessary that one should remain in the US to apply for EAD renewal.

Hi,
I have received the EAD card yesterday with No finger prints available. But we have done our Finger printing before the EAD is approved. Approx 4 weeks before.
Is this normal? Or i should contact USCIS about this?
I know some applicants getting their EAD cards before finger prints were taken for them No finger prints available makes sense.
Any responses are appreciated

According to USCIS field manual for Adjudicators (IOs who approve 485), they should use DOL O*Net Codes, to determine same or similar, while approving. This code is mentioned in your LC.

I took an infopass appointment last october and my FBI name check status was pending. After seeing the USCIS memo on march4th that all namecheck pending for 180 days has been cleared by feb 28th 2009, i went again for an infopass appt last week. IO toldme that my namecheck is still pending.
So i contacted my senators office same day and sent all my info along with the USCIS memo. Next day senators office called me back and told me that they called USCIS and came to know that my name check has been cleared. Senators office told me that infopass information could be wrong or may not have been updated.
IS that a possibility ? any inputs ?
