Hi, I am in 8th year of H1b with 140 approved (EB3) from company A. I would like to switch to company B and planning to start EB2 quickly to enage a new interesting project . I have following questions related to the same and early advice from you all would be highly appreciated as am running out of time in engaging the new project.
1. Can I do H1 transfer from company A to company B using A's 140 approval after my 6 years of original h1b quota. I am currently on 8th year of h1b.
2. Can I able to port the priority date from company A's EB3 filing with the new EB2 filing from company B?
3. If company A cancels the 140, still can I able to port the PD ?

If your I-140 is approved and dates not current you can get one time three years H1 extension. Otherwise one year extension is available.
Since your I-140 is approved You can port the priority dates even if Company A revokes the I-140

If your I-140 is approved and dates not current you can get one time three years H1 extension. Otherwise one year extension is available.
Since your I-140 is approved You can port the priority dates even if Company A revokes the I-140

I don't understand this, we are talking about these backlogs, which are effecting about 300K - 500K skilled immigrants, and we only have about 4000 members yet. We should take this as challenge and go on to drive to speak to people like us to increase the members strength, so we will have significant backing and Senate / House / President will pay attention to what we request.

You can't check PERM status online. But you can get 'PERM Disclosure Data' in Access or TXT format form the following URL:

You can search for all cases approved for your employer in this database or text file.

Hi ,
I received NOID on my i 485 (to be precise here is what it states)
1)" 140 filled on behalf of you has been revoked by my previous employer ,also mentioned as it is after 180 days of filling my 485 ,but my application still valid with in the meaning of section 204 of the act.
but they asked for employment verification letter from my recent employer with duties,educational qualification and offered wage of salary as it is .
2) Inmatter of semerjian ,it was held that an immigrant alien with in the purview of section 212 (a)(14) must establish a bona fied intent to work in USA,immediately or in fore seeable future,in his or her qualifying endeavour or in a related field.
3) It was further held in matter of tanaham ,18 I & N dec.339(reg.comm.1981)under section 245 of act who meets the objective pre requisites is merely eligible to apply for adjustment of status. when an alien seeks the favourable exercise of discretion by this service ,it is incumbent up on alien to establish that he or she merits adjustment
what does number 2 and 3 mean? what should be provided in evidence to that?Please advice.
The date on the notice is june 23 rd ,but i received my mail 2 weeks back to the adress where i work.(say july 24 th)

I'm coming to the US for the first time on H1B. Do I need a one way or a return ticket? My travel agent told me that since I have a multiple entry visa (expiring on Oct 2011) a return ticket is not required unless I need to travel back home within one year. Could someone with knowledge about this issue help me out. I would really appreciate a reply from someone who recently landed in the US on H1B.

If going out of the country for a long time as a GC holder, you may need to apply for travel document (returning resident ????) with USCIS.

Hello friends,
I filed for I-485 in mid-June 2007 but never received the receipt notice
(due to the issue described in this thread: http://immigrationvoice.org/forum/showthread.php?t=11788&highlight=undeliverable).
After months of calling USCIS (probably called at least 10-15 times over past 6 months) and having the lawyer send a written letter, I still did not receive the receipt notice as the customer service reps kept telling me that USCIS doesn't send a duplicate receipt notice.
When I saw that one of my friends who had the same issue received a "Replacement Receipt Notice" after calling them numerous times, I decided to call them again. I was able to convince one of the reps to put in a service request requesting "resend whatever was returned to USCIS as undeliverable".
I finally received a letter from USCIS that they will resend the receipt notice but it has been a few weeks since then and I still have not received the promised receipt notice.
Now I need to file for EAD ASAP but it requires you to attach the receipt notice (Notice of Action I-797C or I-797??).
(lawyer didn't file for EAD with I-485 as I have H1)
So my question is:
Can I use the Biometric appointment notice (ASC Appointment Notice I-797C) instead of I-485 Receipt Notice I-797 to file EAD form I-765 as a proof that I filed I-485 ?
What are the odds that they will send my EAD application back saying that I need the actual I-485 receipt notice?
What are my options?

My cousin is getting married to a US citizen in February 2009. I want to get information about K3 visa for spouse of US citizen. My questions are:

I entered US on H1 and the officer stamped the I-94 expiry date to the expiry date of the passport. I applied for a new passport but forgot about the I-94 expiry date. Does it mean that my H1B is expired and not valid? Can I re-enter US on the same H1B visa. Or, my H1B is no longer valid and I have to use AP?

When did your I94 expired?
Even though it expired and if you are having a EAD you are legal.
Your H1B visa is still valid. If you want you can reenter using the same H1B Visa.
All you need is to extend your stay. I think you can do it by contacting CBP office in your area.

When submitting AR-11 form online, you will be given an option to update the address on your pending applications, this will update address on your I-485. Once the AR-11 and G-28 forms are submitted, follow up in a couple of weeks by calling customer service to verify that your records has been updated with the correct address and attorney information. Also, if possible try retaining your previous attorney for your case, this is always a safe option.

I have my H1 filed in 2008. Due to the market situation, I didn't go for H1 stamping and was never active on H1 so far. I entered US in March 2009 on H4. Now I got a project and want to go for the H4->H1 COS.
I would like to know the steps/process for H4 -> H1 COS.
I know my employer is the best person to answer this. But, the problem is whenever I ask any details, he always tries to abstract the info.
If there are sequence of steps, after which step one is authorized to work? I tried getting the info online, but couldn't . If any of you can give me a pointer or explain the process in detail, it would be very great and helpful.
My employer has applied for LCA. He says that he would initiate the COS process as soon as he gets the LCA. And my employer says that I can start working as soon as he files for COS and no need to wait for the approval. I want to make sure that I don't run into any legal issues. Once the employer has initiated the COS process, is there a way one can track the status and also to verify the status after the completion of the process.
Also, please let me know how much it would cost for normal and premium processing and also the time lines for the normal and premium processing.
Sorry for too many questions. But, please please do help!!!

Just to be clear - where were you born? India or Britain? You can be a British citizen, but if you were not born there, you are counted under the chargeable area of India, not ROW.
There really is no "priveledge" that you will recieve, if you were born in the UK. As Roseball mentions, if you are ROW and can file EB2, your dates would be current when it comes time to apply for I145. If you file EB3, you'll be (currently) stuck in Retrogression at I145 stage.
FWIW - you need to maintain status in the US to retain your greencard.
