I applied my labor as Software Engineer and BEC approved it with a code of Mechanical Engineer. I got it changed, but took me a year though. They kept my change request until the end when they were ready to shutdown BEC.

Any idea how USCIS will determine which application goes to where?
Is it based on the State you are living or based on I-140 approval?

But I do not want to loose my H1B status, mean not to use EAD.It has been almost 1.5 year since I140 approved but I never work for the company who filed greencard for me. Does it matter? What is final solution to get greencard since company is closing.

My company has decided to transfer all cases to a new attorney, and I am planning to go with the decision.
Therefore we need to file a new G-28 (Notice of Entry of Appearance as Attorney or Represesentative).
The form pre-filled by the new attorney says:
In re: All Immigration Matters on behalf of XYZ
Is it okay to sign on something like this? Or am I giving away permission for much more than they need, without knowing!
My AOS(and EAD, AP) applications filed in July 2007 all had separate G-28 forms which said:
In re: I-485 for XYZ on the G-28 pertaining to my I-485,
In re: I-131 for XYZ on the G-28 pertaining to my I-131,
In re: I-765 for XYZ on the G-28 pertaining to my I-765
Hopefully it is okay to give a permission for "all immigration matters" but wanted to double check, just in case!

I am currently working on H1B and have received my EAD and Advance Parole recently. I am planning to travel next month and want to use
my Advance Parole for this purpose. When I come back (to avoid h1b stamping again in home country). Do I need to use EAD to continue
working in US?

AFAIK, EB-2 can be filed either with LC or via NIW route. NIW bypasses LC requirements, but you need to make a strong case for why your advanced qualifications/expertise will serve the interests of US society in the long term, a task often better handled by a competent immigration attorney. EB-1 is similar to NIW in terms of eligibility requirements, but USCIS uses a stricter microscope to approve EB-1 cases, again something an experienced attorney can help with.

Why should the employer hold your salary? If you had any agreement for paying back cost of your GC processing for leaving within a certain period, that would not hold any more (since last June such agreements are illegal)
No employer will write a direct agreement, you will have to payback the GC cost - instead they execute an agreement, employee should payback all the benefits (legal fees, service fee, tuition fee and etc)extended to him, if s/he leaves before X number of months/years - which is legal. Refer to one of the posts, http://immigrationvoice.org/forum/showpost.php?p=211373&postcount=3 , which has same opinion.
BTW, can you post the reference that states this kind of agreement is illegal - I would like to bookmark it, if one available.
