I am thinking of taking an Info Pass nevertheless and try to get some status about my case. If the IO mentions anything about "normal processing times" I am gonna ask him how can he tell whether my case is currently within normal processing times or not ! And see how what response he/she gives me.
They had already made PD bulletins a big joke and now added the Processing date bulletin to that bucket. I wonder what kind of improvements (if at all) in the accuracy of data that we will see after their DB upgrades...

I had a RFE against my I-485 in last week of Nov 07. It was for medical exam, doc forgot to check one box :(
Now the RFE has been replied to and USCIS should hopefully have no further questions on my application. But now the issue is retrogression of EB2 India back to Jan 02 (while I am Jun 03). So does that mean though my application could be cleared by the immigration officer, it will still be put back on shelf because of the retrogression in Dec 07 ?

The following is an article I read and want to share with fellow GC seekers. This clearly indicates that there is a real big need for Tech workers in US and companies are finding difficult to fill the vacancies.

I live and work in the state which is under jurisdiction of TSC. I got my PERM approval from Atlanta National Processing Center. But for some weird reason, my attorney has mailed my I-140 & I-485 documents to NSC and it reached there today(07/27/07). My understanding is that my applications should have been sent to TSC directly. I am kind of worried now as my application has reached the wrong service center. Has anyone encountered a similar situation? Is there anything I could do now to address this issue? Even if NSC internally transfers the documents to TSC, will my receipt date be considered as the date they received at NSC? Is there any directive or memo from USCIS regarding this issue? Please advise.

If you are e-filing, answer to Q 15 is not mandatory, so I guess if in doubt it's safe to skip it.

I believe your sister can apply for you int he 4th Family based category.
Below is the family based catgory, you can find this in any visa bulletin too.
FAMILY-SPONSORED PREFERENCES
First: Unmarried Sons and Daughters of Citizens: 23,400 plus any numbers not required for fourth preference.
Second: Spouses and Children, and Unmarried Sons and Daughters of Permanent
Residents: 114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, and any unused first preference numbers:
A. Spouses and Children: 77% of the overall second preference limitation, of which 75% are exempt from the per-country limit;
B. Unmarried Sons and Daughters (21 years of age or older): 23% of the overall second preference limitation.
Third: Married Sons and Daughters of Citizens: 23,400, plus any numbers not required by first and second preferences.
Fourth: Brothers and Sisters of Adult Citizens: 65,000, plus any numbers not required by first three preferences.

Yes he can travel during the transfer, in order to file the transfer he will have to show latest paystubs from his previous H-1 employer or he has to show that he reported to work and was hired before he can file for a transfer. To file a transfer the USCIS charges $500 +$320+ $750 ($1500 if the petitioner has more than 25 employees).

Samething happened to me. On 11/25/2007 i saw a LUD on my approved I-140 (which was approved in Dec, 2006). And then LUD on 12/06/2007 and 12/07/2007 on I-485 for both self and spouse.
Not sure what it could be?? I filed I-485/EAD/AP in late July, 2007. Have received EAD and have done finger printing. Have not received AP yet. Filing Center in Nebraska. My PD is October, 2005, EB3 ROW.

I was in similar situation during 2006. I applied for H1 1 year extension based on PERM approval. My LC was just 1 month old . Then premium processed my I-140, once I had my I-140, I then premium processed my H1 extension based on approved I-140. Finally got 3 year extension.

Hi All,
We have applied for 485 in July 2007(SELF+SPOUSE+KID). Bcoz of the issue with Fee, my son's 485 packet was sent back. Meanwhile, me and my spouse got our FP notices and we did them at nearest ASC.
My Lawyer corrected the fee and sent my son's 485 back to USCIS and was accepted. I got his reciept numbers in Dec 1st week. My son is 16 months old and we did not recieve his FP notices yet.
Do we receieve FP notices irrespective of the age or do we have any relaxation of kids under a certain age..Any one has any experiance..please share..Appreciate it..

Hey,
I was in the same situation like you are now and I wrote a detailed letter with all paper work, 2 color photographs and also the FP notice and explained the situation. I was lucky to see a LUD the day they received the paper work and in 2 days mine was approved and its on its way now.
Hope this helps. I understand this might not be the case for all but it worked for me.

I read in murthy.com that premium processing is not eligible for Substitution Labors for EB3 category.
