Its true that you have to have valid passport (which is not expiring withing 6 monts) at the time of visa stamping.
Get a new passport before you leave for India. You can apply for a new passport in India Consulates in USA. Google it and you will find out more.

I understand the 180 days rule after filing 485. what if the eb3(140 approved) based 485 has been pending for 180 days, and a newly approved eb2 140 has just been ported to the pending 485.
Yes, 180 days rules applies to your 485 receipt date on your receipt notice.
Is there a rule that the 180 days started over again after porting, since it's a new 140, which implys the applicant intends to work for the 140 position for a period of time.
There is no rule that makes the "180 days" clock to restart.
What are the risks if the applicant changes the job right after eb2 140 gets approved, and changed the underlining 140 of the pending 485 from eb3 to the newly approved eb2.

Is Employer required, by law, for H-1B fling for qualified job applicant? My understanding is that it is upto the employer whether to file any visa sponsorship (including H-1B) for applicant. And its' employer's choice to put "No visa sponsorship" in the job advertisement.

I was issued a new I-94 when my status changed to H1 and another one when i transferred my H1 to another employer. Will that be good enough or should I get in to the country with new I 94.

My wife is on a contract jod to another city and now I get this FP notice which is scheduled in the city I reside. is it possible to reschedule it to another location. On the Notice itself there is an option to reschedule is to another time but not to another location

I filed my EAD online for the first time on May 9th. Yesterday I got an approved card for my wife and I. It is interesting how fast that came and that I did not need to send pictures nor did I go for fingerprinting. My initial finger printing and picture taken for 485 was used to give me the EAD
However, NSC issued the EAD for 1 year only. I called up help desk and asked them why 1 year and not 2 years. They checked their records and saw I was eligible for 2 year, then they transferred me to Level 2 support. The Level 2 support after looking at my case, put me on hold for sometime and then came back and said, the period of EAD was done at the discretion of NSC. So if I do not want it, I should send it back and ask them to reopen my case.
Guys any advise or should I wait for 1 year and hope next year they will issue a 2 year EAD?? I really do not want to send my EAD back...

He can file the H4 extension based on the H1B extension application receipt...
Even if there is a RFE..that does not stop him from filing the H4 extension..Please tell him to file the H4 extension immediately....Usually you do not send a new application along with the answers of RFE..Just file it separately....After H1 goes through they would process the H4 too may be no at the same time but that should be fine....

You should just provide a valid reason for your case for the senator to help. All senators have direct lines to immigration offices. They can expedite your case and the results are astonishing.
My cousin left to india for an emergency and his AP was pending. Contacted senator and got it approved immediately in a day.
I also heard that one person got his 140 approved in a week. Not sure what reason he provided.
But senators are certainly helpful unlike Indian politicians.

can you reword the title? I am not sure how that title is accurate given the background of how macaca was used: Sidharth (who was born and raised in the US, but is of of Indian origin) was called Macaca by George Allen because of the color of his skin. Getting a GC or not getting a GC does not change the color of one's skin so it does not stop people from calling you a macaca...

TSC processing times for Feb is out.
I-485 has advanced to 18th July 07.

Any idea with whats going on with TSC Processing times, my PD is current Nov' 2003, however do not see any movement in the processing times, 485 applied on Aug 7, 007, any idea when they will publish the new processing times? Any way we can know where we are in the 485 proccess?

My mom is scheduled for an interview for a visitor visa at US Consulate, Chennai. My mom is 70 years old and she will be the only person attending for the interview. She has not travelled a lot and she will not be able to figure out everything that is needed inside the consulate before and after the interview by herself. Now - my question is - Can my mom take anyone (say a relative) with her inside the consulate for help?

No, she cannot carry anyone else except herself inside the consulate. A relative can accompany her till she enters the consulate and your mother can ask for a translator and I am sure there would be people to help her, otherwise too.
But as far as someone accomanying her inside the consulate, NO,
And just in case, even if the relative is able to get in with her, it is not advisable to do so.
